Terms & Conditions

This page, and the documents referred to in them, set out any relevant information about the College and the terms and conditions (“Terms”) on which the College supplies you with any of its Goods, Events and Services via the Online Store Website.

These Terms will apply to any Contract between you and the College for the sale or provision of the College’s Goods, Events and Services provided via the Online Store Website. Please read the Terms carefully before ordering any Products from the Site. You should understand that by ordering any of the Colleges Products you agree to be bound by the Terms.  Any specific terms for individual Goods, Events or Services will be found on the relevant page of the Online Store and will apply in addition to the terms and conditions set out here.

1. Introduction and Information about the College

1.1          The College provides the Goods and Services from the Site.

1.3          These Terms do not affect your statutory rights as a consumer. 

1.4          The College reserves the right to amend the Terms from time to time. Amendments are usually made to reflect changes in law, the ways in which the College accepts payments from you and to accommodate changes to the way Goods, Events and Services are supplied. The College will identify (by reference to the date of the Terms) on this page if the Terms have changed but you should ensure that you check these Terms carefully whenever you Order from the Online Store to ensure that you are aware of the current version of the Terms. 

1.5          Each time you Order Products from the College you agree to the Terms in force at that time. 

2. Definitions & Interpretations

2.1          In these Terms the following words shall have the following meaning: 

2.1.2      College– means Callywith College, Old Callywith Road, Bodmin, Cornwall, PL31 2GT 

2.1.3      Contract- means any Contract for the provision of Goods, Events or Services formed between you and the College in accordance with these terms and conditions, any document expressly referred to in them and in conjunction with Online Store product-specific terms.

2.1.4      Goods - means the goods (or any part of them) (e.g. items available for collection from the Art Store or College Shop) available for purchase through the Online Store and set out in an Order.

2.1.5      Events – means the events (e.g. trips and student performances) available for purchase / to order through the Online Store and set out in an Order.

2.1.6      Services – means the services (or any part of them) (e.g. access to the College bus provision) available for purchase / to order through the Online Store and set out in an Order.

2.1.7      Products – means the Goods, Events and Services available for purchase through the Online Store and set out in an Order.

2.1.8      Online Store – means the Callywith College Online Store located at: https://callywith.collegestore.uk/

2.1.9      Order - means any order, including zero cost bursary funded transactions, placed by you on the Online Store in accordance with these Terms.

2.1.10   Purchase Confirmation - means the email sent to you by the College confirming receipt of your Order for Goods, Events and/or Services.

2.1.11   Collection Point- means the designated location for the collection of Goods or delivery of Services as detailed in the instructions on the Online Store or in a confirmation e-mail. 

2.1.12   Terms– mean these terms and conditions.

2.1.13   You and your- means the person or legal entity using the Site and/or placing an Order on the Online Store. 

3. Online Store Availability & Content

3.1          Access to the Online Store is permitted on a temporary basis, and the College reserves the right to withdraw or amend the service provided without notice. The College shall not be liable if, for any reason, the Online Store is unavailable at any time or for any period.

3.2          The College may restrict access to parts of the Online Store, or the entire Site, to users who have registered with the website and/or meet product-specific eligibility criteria.

3.3          You must treat any user identification code, password or any other piece of information provided as part of the College’s security procedures as confidential and not disclose it to any third party. The College reserves the right to disable any user account, at any time, if (in the College’s opinion) you fail to comply with any these Terms.

3.4          You are responsible for making all the arrangements necessary to have access to the Online Store. You are also responsible for ensuring that persons who access the Online Store through your internet connection are aware of these Terms and comply with them.

3.5          Whilst the College will make reasonable efforts to ensure that the information on the Online Store is correct, the material displayed on it is provided without any guarantees, conditions, or warranties as to its accuracy, including but not limited to information about the Products and prices described on it.

3.6          The availability of the Products which are the subject of your Order will be determined by the product description displayed on the Site at the time of placing your Order. The College will make reasonable efforts to ensure that any product description is a fair representation of the actual Products offered.

3.7          The College reserves the right to suspend, modify or amend the Site at any time and the Products offered. 

4. Orders

4.1 Orders for Goods

4.1.1      After placing an Order for Goods through the Online Store, you will receive a Purchase Confirmation from the College acknowledging receipt of your Order. This does not mean that the Order has been accepted.

4.1.2      Your Order constitutes an offer by you to buy Goods on these Terms. All Orders are subject to acceptance by the College, and, where the College accepts an Order, the Product (or part thereof) will be released for collection from the location specified (e.g. from the Art Store or the College Stationery Shop) with a Contract formed only in respect of those Goods collected. The Contract will relate only to those Goods listed in the Purchase Confirmation. The College reserves the right not to accept any Orders placed via the Online Store.

4.1.3      All Orders are subject to availability. If, for any reason, any, or all the Goods you have Ordered are or become unavailable, the College will inform you as soon as possible and will follow the procedures set out in Section 4.3 below.

4.1.4      The College may occasionally substitute Goods of a similar description, and which are of equivalent quality and price where the original Good(s) ordered are unavailable. In the event that you are not happy with the substitute goods available at time of collection, the Goods must not be collected, and we will arrange a full refund or exchange.

4.2 Orders for Events & Services

4.2.1      Where you place an Order for Events or Services through the Online Store you acknowledge that:

4.2.2      The College will make reasonable efforts to provide the Event and/or Service described, but that the College reserves the right to alter Events and/or Services without notice;

and

4.2.3      Specific terms and conditions may apply to an Event or Service; such terms and conditions will be advertised by the College on the page of the Online Store associated with that Event or Service.

4.2.4      The Order constitutes an offer by you to purchase Services on these Terms, and the Contract for the provision of Service between you and the College will be formed when the College sends you the Purchase Confirmation confirming your order(s).

4.3          All Products are subject to availability. If, for any reason, any, or all of the Products you have ordered are or become unavailable or there has been an error in the price on our Site the College will make reasonable efforts to notify you of this as soon as possible after becoming aware of it. In such cases if you have already paid for the Products the College will refund you the amount paid as soon as reasonably possible unless you and the College otherwise agree that you will wait for the Good(s) to be re-stocked. If you have already paid for the Services (either in whole or in part) the College will refund the amounts paid subject to Section 11 below.

4.4          Please note that in some cases the College accepts Orders as agents on behalf of third-party sellers. The resulting legal contract is between you and that third party and is subject to the terms and conditions of that third party. Please ensure that you read any third-party terms carefully because the College is not responsible for and shall have no liability to you for any third-party terms and conditions (or a third party’s failure to comply with such terms).

4.5          The College may provide links within the Online Store to the websites of other companies, whether affiliated with the College or not. The College cannot give any undertaking or warranty that the Products you purchase from third party sellers, or from companies to whose website we have provided a link through the Online Store, will be of satisfactory quality, and any such warranties are disclaimed by the College absolutely. 

5. Delivery/Collection of Goods, Events and Services

5.1          Any date specified by the College for collection of the Goods or delivery of an Event or Service is intended to be an estimate and Products will be made available as soon as reasonably practicable (usually within 5 to 7 working days).

5.2          Delivery is not available in respect of Goods purchased through the Online Store; all Goods are to be collected from the location (e.g. the Art Store or the College Stationery Shop) as provided within the Product description and in the Purchase Confirmation. You will be required to provide proof of payment for an Order at the Collection Point.

5.3          Orders for Goods will be fulfilled at time of collection unless there are exceptional circumstances which the College will endeavour to inform you of in advance.

5.4          Where Services are Ordered, the Services shall, subject to specific criteria (e.g. payment deadlines) provided within the Online Store product-specific description(s), be provided on or from the date specified on the Online Store, within the time frame specified within the Online Store product-specific description or as detailed on the Purchase Confirmation for that particular Service.

5.5          The College shall provide or otherwise procure the provision of the Services in any Purchase Confirmation with reasonable skill and care.

5.6          Activation codes for access to Services (e.g. the Go Cornwall for Callywith College bus provision) may be provided electronically by email and your email address shared with a Third Party (e.g. Go Cornwall) to effect delivery via that Third Party’s platform.

6. Online Payments for Goods & Services

6.1          Unless otherwise agreed by the College in writing, the price for the Goods or Services will be the price as displayed on the Online Store.

6.2          The College takes all reasonable care to ensure that the prices of the Products are correct at the time when the relevant information is entered on to the Online Store. The Online Store contains a large number of Products, and it is possible that despite the College’s best efforts, some of them may be incorrectly priced. Where the correct price is lower than the price stated on the Online Store you will be eligible for a partial refund; the final charge will reflect the correct price at the lower amount. Where the correct price is higher than the price stated on the Online Store, the College will, at its discretion, contact you for instructions before issuing the Product or confirming your booking; or reject the Order and notify you of the rejection.

6.3          If a pricing error is obvious, unmistakeable and could reasonably have been recognised by you as an error, the College is under no obligation to supply Goods or Services to you at the incorrect (lower) price, even after sending the Purchase Confirmation.

6.4          Unless you have obtained the College’s prior written agreement, the College will take your payment in full at the time you place your Order to avoid any delay in the processing of your Order.

6.5          Please ensure that your payment is made in pounds sterling (£) as otherwise your Order will not be accepted. Payment for all products must be by credit or debit card. Please note that the College only accepts payment from the following cards: MasterCard, Visa, and/or Maestro. Any currency conversion costs or other charges incurred in making the payment or in processing a refund shall be borne by you and shall not be deductible from the payment due to the College.

7. Limitations and Exclusions

7.1          If buying from Goods and/or Services as a consumer the following shall apply:

7.1.2      The College will be liable for a failure to comply with these Terms where the breach is one that was contemplated by you and the College at the time of the Contract and arises from our negligence but not where the loss or damage is not one which was contemplated at the time of the Contract.

7.1.3      Nothing in these Terms shall render the College liable to indemnify you in respect of any liability of any kind incurred by you to any other person but this is not an exclusion of any liability that may arise by virtue of a breach by the College of these Terms or any negligence on the part of the College, its employees or agents.

7.1.4      The College does not exclude or limit its liability for:

7.1.4.1 death or personal injury caused by its negligence;

7.1.4.2 fraud or fraudulent misrepresentation;

7.1.4.3 any breach of any implied terms which cannot be excluded or limited at law.

7.2          Except as expressly stated in these Terms the College does not give any warranties, representations, or undertakings in relation to the Goods, Events or Services. Any representation, condition or warranty which might be implied or incorporated into these Terms by statute, common law or otherwise is expressly excluded to the fullest extent permitted at law. In particular the College is not responsible for ensuring that the Goods and/or Services are suitable for any particular purpose or non-infringing.

8. Consumer Rights

8.1          The College supplies the Products to you entirely for your private non-commercial use. You agree not to use the Products or Services (or outputs from the Services) for any commercial, business or re-sale purposes unless otherwise agreed with the College in writing.

8.2          When purchasing Goods from the College as a consumer, you may, subject to Online Store product-specific terms and clauses 8.4, 11.1, 11.2 and 11.3, cancel a Contract at any time within 7 days, beginning on the day after Goods are made available to you at the Collection Point (or, where Services have been Ordered, within 7 days of receiving the Purchase Confirmation). In this case, you will receive a full refund on the price paid for the Goods or Services in accordance with the refunds policy set out in clauses 11.1, 11.2 and 11.3 below.

8.3          In order to cancel a Contract, you must inform the College, as laid out in clause 8.3.1 below, and any Goods must be returned immediately at your own cost and in the same condition in which they were received by you. You have a legal obligation to take reasonable care of the Goods while they are in your possession. If you fail to comply with this obligation the College may have a right of action against you for compensation.

8.3.1      You must inform the college by writing to [email protected]. Please put ‘Refund Request – Online Store’ in the subject header line. You should include the following details in your notification:

- your order number
- the reason for the cancellation/return if this is due to a fault.

You may wish to keep a copy of your cancellation notice for your records.

8.4        You do not have the right to cancel a Contract for the supply of the following Goods:

8.4.1     Goods that have been made to your personal specification;

8.4.2     Goods which by their nature cannot be returned, such as perishable items;

8.4.3     Goods or items which are only of value for a limited time, or

8.4.4     Goods for which the sealed packaging has been opened or damaged by you.

8.3.5      Services where supply has already commenced with your agreement.

8.4        This provision does not affect your other statutory rights as a consumer.

8.5        The provisions of this clause 8 do not apply to those purchasing Products on behalf of a business.

9. Communication with the College and the College’s Intellectual Property Rights

9.1          When you visit the Online Store or send an e-mail to the College, you are communicating with the College electronically. The College may communicate with you by e-mail or by posting notices on the Online Store.

9.2          All content including pictures, designs, logos, photographs, text written and other materials on the Online Store and associated with the Products purchased by you are owned, controlled, or licensed to the College. The College’s intellectual property rights are protected by law. Unauthorised use of such content is prohibited. Please refer to Section 24 for a description of what you are permitted to do with the content.

10. Risk and Ownership of Goods

10.1       Goods will be at your risk from the time of collection. If collection is delayed due to any act or omission on your part, the College’s responsibility for everything other than damage caused directly by its negligence will end on the date for collection of the Goods (as/where set out in the Purchase Confirmation).

10.2       Ownership of Goods will only pass to you when the College has received payment in full of all sums due in respect of the Goods AND when the Goods have been collected from the Collection Point.

11. Cancellation and Refunds 

11.1 Cancellation and Refund of Goods

11.1.1   Where the Contract is cancelled within the 7-day period in accordance with clause 7 above, the College will process the refund due to you as soon as possible and in any case within 30 days of receiving the notice of cancellation. In this case, the College will refund the price of the Goods returned in original, re-saleable condition in full, however you are responsible for the cost of returning the Goods to the College. If you wish to return Goods for being faulty the procedure in Section 11.1.4 will apply.

11.1.2   For any other reason the College will examine the returned Goods and will notify you of any refund via email within a reasonable period. The College will process the refund as soon as possible, and in any case, within 30 days of confirming that you are entitled to a refund. Please note that in order to be eligible for a refund under these circumstances, Goods must be returned in the same condition in which they were received by you.

11.1.3   If you wish to cancel an Order or any part of it at any time or for any reason other than as set out in clauses 10.1 or 11.1.1 above, and unless the Goods are defective, you acknowledge that payment of any refunds and/or provision of any exchanges will be at the College’s sole discretion.

11.1.4 If you return Goods to the College because they are faulty or incorrectly described, the College will refund the price of the defective Goods.

11.2 Cancellation and Refund of Services

11.2.1   If the College should have to postpone a Service, the College will notify you as soon as possible and provide a new date for the delivery of the Service. 

11.2.3   The College shall not be liable for any costs, losses or expense that you may incur as a result of its cancellation of a Service, including but not limited to travel costs.

11.2.3   Services may (subject to clause 11.2.4) be cancelled by you without charge at the College’s discretion.

11.2.4   The right to Cancel Services does not apply to the purchase of Services where, with your agreement and/or as detailed within Online Store product-specific descriptions and terms, the College has already supplied or started to supply the Services; the College will be entitled to retain payment in full.

11.3 Cancellation and Refund of Events

11.3.1   The College reserves the right to cancel any Event at its sole discretion at any time prior to the date of that Event.

11.3.2   Where such a cancellation takes place, the College will notify you of that cancellation in writing and shall either offer you an alternative Event or refund you the amount paid in respect of that Order. 

11.3.3   The College shall not be liable for any costs, losses or expenses that you may incur as a result of its cancellation of an Event, including but not limited to travel costs.

11.3.4   Events may (subject to clause 11.3.5) be cancelled by you without charge at any time up to 30 days prior to the Event / final possible date of withdrawal from the Event as provided within the Product-specific description of the Event or Offsite Activity on the Online Store. Please note that where an Event is Ordered within 7 days of the date of the Event, you may only cancel your Order and obtain a full refund of the amount paid where provision for this was provided within the Product-specific description of the Event or Offsite Activity on the Online Store.

11.3.5   The right to Cancel does not apply to Events where, with your agreement and/or as detailed within Online Store product-specific descriptions and terms, the College has already supplied or started to supply the Event; the College will be entitled to retain payment in full.

11.4 Car Park Permits

11.4.1   If you withdraw from a course after the course start date any payment already made for any car park permit will be non-refundable.

11.5 Bus & Travel Passes

11.5.1   Passes are non-refundable but are transferable to another student if there is a waiting list and another student requires the allocated space.

11.5.2  If you withdraw from a course after the term start date, any payment already made for any bus or travel pass will be non-refundable and your ticket will be revoked.

12. College Warranties

12.1     The College warrants that any Goods purchased from the College through the Online Store will, on collection, conform in all material respects with their description, be of satisfactory quality, and be reasonably fit for all the purposes for which Goods of that kind are commonly supplied.

12.2     Where Services are ordered through the website, the College warrants that they will be provided with reasonable skill and care. All other warranties are, to the fullest extent permitted by law, excluded from any Contract made under these terms and conditions.

13. Customer Warranties

13.1 By placing an Order using the Online Store, you warrant that:

13.1.1 You accept these Terms in place at the time of using the Online Store or purchasing Products from the Online Strore.

13.1.2 Any personal information you provide the College will be complete and accurate.

14. Security

14.1       The College is committed to maintaining your privacy and for this reason all payments are made using a specialist payment service provider. All personal data and payment details which are entered through the Site are encrypted to comply with the Payment Card Industry Data Security Standard (PCIDSS).

14.2       The College shall not be liable for any failure by you to properly protect data from being seen on their screen by other persons or otherwise obtained by such other persons, during the online payment process or in respect of any omission to provide accurate information in the course of the online payment process. Once your payment transaction has been completed you will be redirected back to the Online Store where you will receive an e-mail confirmation of your Order.

15. Viruses, Hacking and Other Offences

15.1       You must not misuse the Online Store by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or harmful. You must not attempt unauthorised access to the Online Store, the server on which the Online Store is stored or any server, computer or database connected to the Online Store, or attack the Online Store via a denial-of-service attack, distributed denial of service attack or other similar means.

15.2       Anyone breaching this provision would commit an offence under the Computer Misuse Act 1990. The College will report any such breach to the relevant law enforcement authorities and will cooperate with those authorities by disclosing the identity of those responsible to them. In the event of such a breach the individual responsible will lose the right to use the Online Store immediately.

15.3       The College will not be liable for any loss or damage caused by a distributed denial of service attack, viruses or other harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of the Online Store or downloading any material posted on it or any website linked to it.

16. Notices and Communication

16.1       Applicable laws require that some of the information or communications sent by the College be in writing. When using our Online Store, you accept that communication will be mainly electronic by email. For contractual purposes, you consent to receive communications from the College electronically and agree that all agreements, notices, disclosures, and other communications that the College provides to you electronically in respect of an Order satisfies any legal requirement that such communications be in writing.

16.2       The College may communicate and give notice to you via post or email regarding Products available on the Online Store. Notice will be deemed received and served 24 hours after an email is sent, or 2 days after the posting of a letter by first class post. In proving the service of any notice, it will be sufficient to prove that, in the case of a letter that letter was correctly addressed, stamped and posted, and in the case of an email that the email was correctly addressed and sent. 

17. Force Majeure

17.1       The College will not be liable or responsible for any failure to supply Goods or Services that have been ordered, or for any delay in doing so, or for any damage or defect to Products collected or Service delivered caused by an Event Out of the College’s Control (as described in Section 17.2 below).

17.2       An Event Outside of the College’s Control means any act or event beyond the College’s reasonable control including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster or failure of public or private telecommunications network or impossibility of the use of public or private transport.

17.3       If the Event Outside of the College’s Control occurs that affects the performance of the College’s obligations under a Contract:

17.3.1   The College will notify you as soon as possible.

17.3.2   The College’s obligations under a Contract will be suspended and the time for performance of its obligations will be extended for the duration of the event.

17.4       The College reserves the right to defer the date of collection of Goods or to cancel the delivery of Services or supply of Goods in the case of any Event Outside of the College’s Control or which are beyond its reasonable control, and which prevents or hinders the delivery of the Goods, Events or Services.

18. Privacy Statement and Data Protection

18.1       The College is committed to protecting your privacy. The College will only use your personal details, collected when you use the site, lawfully and in accordance with the principles of the Data Protection Act 2018 and GDPR regulations. The College will ensure that your personal data is kept confidential and is not used or disclosed other than as provided for under:

18.1.1   these Terms;

18.1.2   the Callywith College Data Protection Policy

18.1.3   or as required by law in accordance with the Data Protection Act 2018 and GDPR regulations.

18.2       The College will process and hold the information provided by you only for the purposes of supplying the Goods, Events or Services which are the subject of your Order.

18.3       The College does not sell, distribute, lease or otherwise make available any personal data submitted by visitors to the Online Store Website to third parties unless we have your permission or are required by law to do so.

18.4       In order to deliver certain Services, for example an overseas trip, the College may be required to provide personal data to a third-party provider (e.g. tour operator).

18.5       Links from the Online Store may take you to sites not covered by our Terms privacy policies referred to in Section 18.1. The College recommend you check the privacy policies for these sites before submitting any personal data.

18.6       The College may use technology to track the patterns of behaviour of visitors to the Online Store Website. This can include using a ‘cookie’ which would be stored on your browser. You can usually modify your browser to prevent this activity.

19. Third Parties

19.1       These Terms are not enforceable under the Contract (Rights of Third Parties) Act 1999 by any person not a party to them.

20. Law and Jurisdiction

20. 1      These Terms and all orders placed via the Online Store will be governed by and construed in accordance with English Law and all parties submit to the exclusive jurisdiction of the English Courts.

21. Variation

21.1       The College reserves the right to revise and amend these Terms from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.

21.2       You will be subject to the policies and Terms in force at the time that you Order Goods and Services from the College, unless any change to those policies or these Terms is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if the College notifies you of the change to those policies or these Terms before sending you the dispatch or purchase confirmation (in which case the College has the right to assume that you have accepted the change to the Terms, unless you notify the College to the contrary within seven working days of receipt by you of the Goods or Service).

22. Bursary Funds

22.1     Current Callywith College students may be eligible for financial support through bursary fund(s) administered by the College.

22.1.1   Access to bursary funds via the Online Store is subject to award. Bursaries are academic-year-specific and full eligibility criteria and terms can be found on the College website.

22.2     Eligible students may be afforded:

22.2.1   exclusive access to bursary-specific discounts in respect of individual Products available for Order via the Online Store.

22.2.2   access to bursary-exclusive Products as available for Order via the Online Store.

22.2.3   access to a student-specific wallet of bursary funds to cover the Order price (in full or in part) of individual Products as available for Order via the Online Store (e.g. Stationery & Art Store Goods).

22.4     Orders for Goods, Events or Services completed using bursary funds (both partial and full payment) fall under the scope of these terms and conditions (including any document expressly referred to in them and in conjunction with Online Store product-specific terms).

22.4.1   Rights to cancellation and/or entitlement to refund under those terms and conditions are not affected; the refund will credit the original, including bursary wallet, payment method.

22.4.2   Where part of an Order considered for refund consists of multiple Goods, Events or Services and the total student-specific bursary funds available at time of Order were lower than the combined Price of all Ordered Products (with balance paid via card payment), the Bursary will be credited first and up to the value of the fund’s contribution.

23. Complaints and Contact

23.1       If you wish to contact the College about your Order or you have a complaint about any aspect of the Online Store or the Products which are the subject of your Order please contact the College at: [email protected] 

23.1.1   Please put ‘Finance Department – Online Store’ in the subject header line.

24. Terms applicable to your use and access to our Online Store Website

24.1       Notwithstanding your acceptance of the provisions set out in Sections 1 to 22 of these Terms the following provisions and those set out in Sections 1, 2, 7, 8, 9, 15, 16, 17, 18, 19, 20, 21 and 23 in respect of your use of our Online Store Website regardless of whether you are ordering Goods and/or Services or not.

24.2       Your access to and use of the Online Store Website is subject to the following terms set out below and contained in the Privacy Statement and Data Protection Policy.

24.3       The Online Store and all its contents, including but not limited to, the text, Online Store (as well as the organisation and layout of the Online Store), design, logos, graphics, icons, and publications on the Online Store (“Content”) are owned and copyrighted by the College or its licensors with all rights reserved unless otherwise stated.

24.4       All trademarks, copyright, database rights, patents and other intellectual property rights (“IP”) in the Content are owned by the College or its licensors.

24.5       Nothing in these Terms shall be interpreted as conferring any express or implied licence to use any IP that belongs to the College or any third party. Unless stated in these Terms you are not permitted to use any Content or IP without the College’s written permission.

24.6       When setting up an account on the Online Store you should take all necessary steps to ensure that any username and password are kept secret and secure, and you should inform the College immediately by email on [email protected] if you have reason to believe that your username and password have become known to anyone else or are being used without your authorisation.

24.7       You are permitted to use the Online Store if you follow the following rules:

24.7.1   You may download the Content, but only for informational, non-commercial, non-profitable and personal use and provided that you do not remove, adapt, alter or obscure any of the information, content or notices contained in the Content. You may not (without the College’s permission in writing) reproduce, download, post, broadcast, store in any medium (including another website) transmit, make available to the public or otherwise use the Content (and any IP in the same) in any way except for your own personal, non-commercial use;

24.7.2   You shall not distribute, modify, copy (except as set out above) transmit, display, license, create derivative works from, transfer or sell or otherwise use the Content without the College’s prior written permission;

24.7.3   You shall not use the Online Store for any purpose that is prohibited by these Terms or could constitute a criminal offence or violate any law and that you will not use the Online Store to post or transmit any infringing, threatening, false, misleading, abusive, harassing, discriminatory, vulgar, obscene, indecent, scandalous, offensive, inflammatory, blasphemous, pornographic or profane material or material in breach of confidence or privacy. The College may, in its absolute discretion remove any such material; or

24.7.4   You shall comply with any local laws and regulations of the jurisdiction from which you access the Online Store. The Online Store should not be accessed in any jurisdiction where for any reason the publication or availability of the Online Store is prohibited.

24.8       The College reserves the right for any reason to refuse access to the Online Store, suspend and/or terminate any account you may have.

24.9       The Online Store may contain links to other websites owned or operated by parties other than the College. The links are provided for convenience only. If you use the links, you may leave the Site or alternatively the link and third-party website content may be framed within the Online Store. The College has not reviewed the third-party websites and does not control and is not responsible for their operation nor for the content on or the terms/policies on the same. You access third party sites from the Online Store at your own risk.

24.10     While the Content on the Online Store may include inaccuracies or typographical errors, if error is brought to the College’s attention it will try and correct them. While every effort is made to ensure that the information on the Online Store is correct, you should be aware that the information it contains may be incomplete, incorrect or may have become out of date. The College uses reasonable care and skill in providing you with access to the Online Store however the Online Store and Content are provided to you “as is” and on an “as available” basis without any representations of any kind including security or accuracy save that any rights you have as a consumer are preserved.

24.11     The following exclusions relate to your use of the Online Store only as opposed to your purchase of Goods, Events and/or Services via the Online Store which is covered in Sections 1-22 above. Use of the Online Store is at your own risk. To the fullest extent permissible by law, the College excludes its liability and that of its officers, agents and sub-contractors for any of the following losses or damage:

24.11.1                 Loss or damage incurred by you or any third party where the College is compliant with these Terms;

24.11.2                 Loss or damage incurred by you or any third party where the College is not compliant with these Terms, but the loss or damage is not one that would have been anticipated by you or the College when using the Online Store;

24.11.3                 Any loss which is indirect to the main loss or damage suffered by you and which as not anticipated including without limitation, loss of data, loss of profit, loss of opportunity or goodwill;

24.11.4                 Any loss or damage suffered by you for not being able to provide you with access to the Online Store or if the Online Store is interrupted or provided with errors or for any loss or damage arising out of an Event Outside of the College’s Control.

24.12     Nothing in these Terms is intended to limit or exclude your statutory rights as a consumer. For further information about your legal rights please refer to your local authority Trading Standards Department or Citizens Advice Bureau.

24.13     The College does not guarantee or warrant that the Online Store will be continuously available or be uninterrupted, free from bugs or errors, viruses or omissions. The College reserves the right to amend, suspend or discontinue some or all the Online Store without providing notice to you.

24.14     If at any time any part of the Terms is determined to be invalid, illegal or unenforceable in any respect pursuant to applicable law then that invalid, illegal or unenforceable part shall be severed from the remainder of the Terms and the validity, legality and enforceability of the remainder of the Terms shall not be affected or impaired in any way.
